Attorney Releasing Video Of Teen Stun Gun Incident In Bastrop County

In just a few hours, video of a sheriff's deputy tasing a teenager at a school in Bastrop is expected to be released. It's a key piece of evidence in a case filed by the teen's family against the Bastrop County Sheriff's deputy. On Wednesday morning, the teen is still in a coma after months in the hospital.

For the last two months, Noe Nino de Rivera has been in a coma with signs of serious brain damage. Since day one, his family has said de Rivera wasn't doing anything wrong, now attorneys are releasing video to prove it.

We're talking about surveillance video from inside a hallway of Cedar Creek High School. On November 20, 2013, the Sheriff's Department says two deputies tried to break up a fight between two girls.

That's when they say De Rivera began acting aggressively, leading a deputy to shock him with a stun gun. It's at that time de Rivera fell to the ground and hit his head. However the family's attorney says the video tells a much different story.

"What you see is you see the aftermath of an argument or a fight that had been broken up," said Adam Loewy, the family's attorney. "There's no fight going on, and what you have is Noe literally standing there and these officers come up to him and shoot a Taser, and the next thing you see is Noe go down."

De Rivera's family has filed a federal civil lawsuit against the school district, the county, and the deputy involved. We're told his family will be at the 10 a.m. press conference Wednesday morning.
