Austin Still Charging Drainage Fee

Austin residents are still being charged a drainage fee that a judge declared invalid a month ago.

The Austin American-Statesman reports Judge Amy Clark Meachum ruled the fee invalid in June. A 2009 lawsuit said the city was unfairly charging some apartment and condominium residents the same amount as people in larger single-family homes.

The plaintiffs' attorney says he's considering filing another lawsuit. He wants Austin officials to remove the fee until it's changed to make it more fair to customers.

City spokesman Kyle Carvell says the city's Law Department will likely seek more direction from the judge about how it must change the drainage fee.

The fee raises millions of dollars for Austin and helps fund programs including flood warning systems.
