Judge Drops 1 Charge Against Former Leander HS Football Player

4:05 p.m. UPDATE: The jury has opted not to hear closing arguments or begin deliberations in the case until Tuesday morning. The jury has been dismissed for the day.

ORIGINAL STORY:

A Williamson County judge has dropped one charge against a former Leander High School football star accused of sexually assaulting two children.

The prosecution rested its case last week against Greg Kelley. He is accused of molesting two boys at an in-house daycare he was living at in Cedar Park.

The defense is trying to get the jury to believe the two alleged victims made up the allegations.  And Last Friday a psychologist told jurors it's not uncommon for children to make up what he calls "false memories."

On Monday the judge struck one count of indecency with a child thru contact since the alleged victim testified in court Kelley didn't touch him.

Kelley is currently on the stand testifying in his own defense. He says he never "intentionally or knowingly" touched either of the alleged victims for his own sexual gratification.
