Trial To Begin In Fatal Shooting After Texas Wreck

A Southeast Texas father accused of killing a drunk driver in a fit of rage after his two sons were fatally struck on a rural road near their home is set to have his day in court.

Jury selection in the murder trial of David Barajas began Monday afternoon in Angleton.

Opening statements in the case were expected Tuesday.

Authorities allege Barajas shot Jose Banda after the December 2012 accident near Alvin, about 30 miles southeast of Houston. The accident claimed the lives of 12-year-old David Jr. and 11-year-old Caleb.

If convicted, Barajas faces up to life in prison.

Barajas' attorney, Sam Cammack, says his client didn't kill Banda.

Prosecutors face various difficulties at trial. No weapon was recovered and no witnesses have identified Barajas as the shooter.
