Woman Files $5M Lawsuit For Sister's Bastrop Co. Shooting Death

A woman is suing Bastrop County and its sheriff over the shooting death of her sister by a deputy in February.

Deputy Daniel Willis (pictured) killed Yvette Smith while responding to a call outside her boyfriend's home on Feb. 16. Smith was shot in the doorway.

It started when deputies responded to a report of two males fighting over a gun. They responded to the 100 block of Zimmerman Avenue and encountered one male outside. The other was inside the residence. Before the shooting, the deputies tried to make contact with the subject inside the home but got no response, according to investigators.

Initially the Bastrop County Sheriff's Office said the woman had a gun, but hours later took back that statement.

The suit filed Friday accuses the county of negligence in hiring, training, and supervising Willis.

Smith's sister is asking for $5 million in damages.

Willis has been charged with murder for Smith's death.
