Federal appeals court upholds dismissal of former APD detective's manslaughter charge
A federal appeals court has upheld the dismissal of a manslaughter charge against former Austin Police Department detective Charles Kleinert.
The United States Fifth Circuit Court of Appeals issued the ruling on Thursday.
Kleinert shot Larry Jackson Jr. during a foot chase in July 2013 in Central Austin. Kleinert was investigating a bank robbery at the time. Kleinert said his gun discharged accidentally during a struggle.
A grand jury indicted Kleinert, but it was thrown out in 2015 by a federal district court in Austin because he was operating as a federal agent at the time. The judge citied a 126-year old court ruling protecting federal officers from state prosecution in certain cases.
The City of Austin has since paid $1.85 million in settlement money to Jackson's family.
